Acceptance of Terms
By accessing or using the Hari Om Interior website or engaging Hari Om Interior for its services, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use the website or engage our services.
Services Description
Hari Om Interior provides high-end interior execution and turnkey interior services for hospitality, commercial, residential, and specialised interior projects. Our services may include project execution, project coordination, custom furniture manufacturing, material and finish execution, installation, and other activities agreed upon for a specific project.
The scope, deliverables, specifications, timelines, payment terms, and other project conditions will be governed by the applicable project agreement, work order, quotation, or other written arrangement between Hari Om Interior and the client.
Client Responsibilities
Clients are responsible for providing accurate project information, approved drawings and specifications where applicable, timely decisions, feedback, and reasonable access to the project site.
Clients are also responsible for obtaining permits, approvals, permissions, or other statutory requirements that are specifically assigned to them under the applicable project agreement. Delays resulting from changes, approvals, site access, information, or other matters outside Hari Om Interior's reasonable control may affect the project schedule.
Project Scope and Changes
Project work will be carried out according to the agreed scope, specifications, drawings, quantities, materials, finishes, and other requirements stated in the applicable project documentation.
Any changes, additions, substitutions, or modifications requested after approval may require changes to the project cost, materials, scope, or completion schedule. Such changes will be subject to mutual agreement between the parties.
Intellectual Property
Unless otherwise agreed in writing, intellectual property rights in drawings, documents, technical materials, photographs, specifications, and other materials created or supplied by Hari Om Interior remain subject to the applicable project agreement and applicable law.
Clients may not reproduce, distribute, commercially use, or disclose proprietary materials belonging to Hari Om Interior beyond the agreed project purpose without prior written permission, except where such use is otherwise permitted by law or agreed in writing.
Payment Terms
Payment terms, advance payments, milestone payments, taxes, retention amounts, and other financial conditions will be specified in the applicable quotation, work order, project agreement, or invoice.
Where a client fails to make payments within the agreed period, Hari Om Interior may suspend or delay the relevant work after providing notice, subject to the applicable project agreement. Any applicable interest, charges, or consequences of delayed payment will be governed by the agreed project terms.
Materials, Products and Warranties
Materials, products, fittings, hardware, and other third-party items used in a project may be subject to the warranties and conditions provided by their respective manufacturers or suppliers.
Hari Om Interior will execute work according to the agreed specifications and applicable project requirements. Any warranty relating to workmanship or specific project components will be governed by the applicable project agreement.
Timelines and Delays
Project timelines are based on the agreed scope, site conditions, availability of materials, approvals, access, coordination requirements, and other project dependencies.
Hari Om Interior will make reasonable efforts to meet agreed timelines. However, delays caused by factors outside its reasonable control, including changes in scope, delayed approvals, site restrictions, material availability, third-party dependencies, force majeure events, or client-related delays, may affect completion dates.
Limitation of Liability
To the extent permitted by applicable law and subject to the applicable project agreement, Hari Om Interior will not be responsible for indirect, incidental, special, or consequential losses arising from a project.
Any limitation of liability will remain subject to the specific terms agreed between Hari Om Interior and the client and to applicable law.
Confidentiality
Hari Om Interior will maintain the confidentiality of client information and project-related information received in connection with its services, subject to applicable law and the terms of the relevant project agreement.
Project information may be shared with employees, contractors, consultants, suppliers, or other parties where reasonably required to execute the project.
Project Photography and Marketing
Where permitted under the applicable client agreement or otherwise authorised by the client, Hari Om Interior may use photographs, videos, or project information for portfolio, website, marketing, media, or promotional purposes.
Where the client has agreed otherwise in writing, such restrictions will apply accordingly.
Force Majeure
Hari Om Interior will not be responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, fire, government actions, strikes, civil disturbances, epidemics, transportation disruptions, supply-chain disruptions, or other events that could not reasonably have been prevented or anticipated.
Where such circumstances affect a project, the parties may mutually agree on appropriate changes to the project schedule or affected scope.
Dispute Resolution
The parties will first attempt to resolve any dispute or difference arising from the services or applicable project agreement through good-faith discussions.
If the dispute cannot be resolved through such discussions, it will be subject to arbitration in Mumbai, Maharashtra, in accordance with the Arbitration and Conciliation Act, 1996 and other applicable laws of India.
